Do Not Get Taken for a Ride by Denying Transportation
An Employer/Carrier may be responsible for providing transportation to authorized medical appointments. In Williams v. Onyx Waste Services of Florida, 2011 Fla. App. LEXIS 10566 (Fla. 1st DCA July 7, 2011), the 1st DCA reversed in part the JCC’s order in Williams v. Onyx Waste Services of Florida, OJCC Case NO.: 03-046486TMB ( Div. of Admin. Hearings, OJCC, West Palm Beach Dist. Office, October 8, 2010). There, the JCC had denied the Claimant’s PTD claim, as well as a claim for transportation to authorized medical appointments.

Motions for Sanctions and Motions to Compel may be more important than the issue being addressed by the Motion. An order from the JCC awarding sanctions for failure to appear may, for example, also help an Employer/Carrier avoid being ordered by the JCC to provide benefits requested by the claimant later in the case.
